Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

For the purposes of this Privacy Policy:

  • Account means a unique account created for You to access our Service or parts of our Service.

  • Business, for the purpose of the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA), refers to the Company as the legal entity that collects Consumers’ personal information and determines the purposes and means of the processing of Consumers’ personal information.

  • Company (referred to as either “the Company”, “We”, “Us” or “Our” in this Agreement) refers to Amendment AI LLC applications, website, and services. For the purpose of the GDPR, the Company is the Data Controller.

  • Consumer, for the purpose of the CCPA/CPRA, means a natural person who is a California resident.

  • Cookies are small files that are placed on Your computer, mobile device, or any other device by a website, containing details of Your browsing history on that website among its many uses.

  • Data Controller, for the purposes of the GDPR (General Data Protection Regulation), refers to the Company as the legal person which alone or jointly with others determines the purposes and means of the processing of Personal Data.

  • Device means any device that can access the Service such as a computer, a mobile phone, or a tablet.

  • Opt-Out Preference Signals refers to automated user-configured preferences, including the Global Privacy Control (GPC), that communicate a consumer’s choice to opt out of the sale or sharing of their personal information.

  • Personal Data (or Personal Information) is any information that relates to an identified or identifiable individual. Under GDPR, it refers to any data identifying a person directly or indirectly. Under the CCPA/CPRA, it refers to information that identifies, relates to, describes, or is reasonably capable of being associated with You.

  • Sale and Sharing: Under the CCPA/CPRA, “Sale” means disclosing or transferring personal information to a third party for monetary or other valuable consideration. “Share” or “Sharing” means disclosing or transferring personal information to a third party for cross-context behavioral advertising, whether or not for monetary consideration.

  • Service refers to the Website and AI-driven services offered through the domains.

  • Service Provider means any natural or legal person who processes data on behalf of the Company. It includes third parties employed to facilitate or analyze the Service, cloud hosting platforms, payment processors, and artificial intelligence sub-processors. Under GDPR, these entities are Data Processors.

  • Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself.

  • Website refers to https://amendment.ai, https://amendmentai.com, and https://runscoutgpt.com.

  • You means the individual accessing or using the Service, or the organization on behalf of which such individual is accessing or using the Service.


Collecting and Using Your Personal Data

Types of Data Collected

Personal Data While using Our Service, We may ask You to provide Us with certain personally identifiable information that can be used to contact or identify You. Personally identifiable information may include, but is not limited to:

  • User Content and Prompts: Text inputs, prompts, queries, document uploads, and configuration settings submitted to or processed through our AI applications.

Usage Data Usage Data is collected automatically when using the Service. Usage Data may include information such as Your Device’s Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Service that You visit, the time and date of Your visit, the time spent on those pages, unique device identifiers, and other diagnostic data.

Tracking Technologies and Cookies We use Cookies and similar tracking technologies to track activity on Our Service. Where required by applicable law (such as the EU ePrivacy Directive and GDPR), non-essential Cookies (analytics and marketing) are only set after You have provided affirmative, opt-in consent through our cookie management interface. We share Personal Data strictly with:

  • Service Providers and Sub-processors: Infrastructure providers, payment processors, and third-party AI APIs essential to delivering Service outputs.

  • Corporate Affiliates: Subsidiaries or corporate parents operating under this Privacy Policy.

  • Legal and Regulatory Authorities: When mandatory under valid court orders, subpoenas, or statutory mandates.


AI Sub-processors and Machine Learning Training Policies

Our applications utilize third-party artificial intelligence platforms and large language models (LLMs) to generate outputs, analyze input, and provide automated assistance.

  • AI Vendors: Depending on the specific service You use, Your prompts, inputs, and documents may be processed by commercial API service providers (such as OpenAI, Anthropic, or cloud infrastructure hosts such as AWS or Google Cloud). These vendors act as sub-processors bound by data protection agreements that restrict use of Your data solely to executing the requested processing.
  • Model Training: We do not sell or rent Your prompts, inputs, or generated output to third parties. Furthermore, customer prompt inputs and API data are not used to train or fine-tune public foundation models without Your explicit written consent.

Retention of Your Personal Data

The Company retains Personal Data only as long as necessary to fulfill the purposes set out in this Privacy Policy, comply with legal and accounting obligations, resolve disputes, and maintain system security. Category-specific retention criteria:

  • Account Identifiers: Retained for the duration of the active account relationship plus statutory tax/accounting periods (up to 7 years post-termination).
  • Commercial/Transaction Records: Retained for 7 years to comply with statutory financial auditing obligations.
  • Customer Prompts & Content: Retained in operational logs for up to 30 to 90 days for abuse monitoring and system debugging, unless You delete them earlier or request shorter programmatic retention.
  • Usage and Diagnostic Data: Retained for internal analysis for up to 14 months, after which it is anonymized or aggregated.

Transfer of Your Personal Data

Your information, including Personal Data, is processed at the Company’s operating offices and by infrastructure hosts located in the United States and other global regions. For transfers from the European Economic Area (EEA), the United Kingdom, or Switzerland to countries without an adequacy decision, the Company relies on approved legal mechanisms, including the EU Standard Contractual Clauses (SCCs) and the EU-U.S. Data Privacy Framework, backed by technical security measures.

Disclosure of Your Personal Data

Business Transactions If the Company is involved in a merger, acquisition, or asset sale, Your Personal Data may be transferred. We will provide notice before Personal Data is transferred and becomes subject to a different Privacy Policy.

Law enforcement The Company may disclose Your Personal Data if required to do so by law or in response to valid requests by public authorities.

However, no internet transmission or electronic storage architecture is 100% secure, and We cannot guarantee absolute security.

Email Marketing: You may opt-out of marketing communications at any time via the unsubscribe link provided in our emails.

Legal Basis for Processing

We process Personal Data under: Consent (Art. 6(1)(a)), Performance of a Contract (Art. 6(1)(b)), Legal Obligations (Art. 6(1)(c)), and Legitimate Interests (Art. 6(1)(f)) in operating secure and functional software.

  • Sensitive Personal Information (SPI): We collect account login credentials strictly to provide the Service. We do not use or disclose Sensitive Personal Information for purposes other than performing the services reasonably expected by an average consumer.

Notice of Sale or Sharing

The Company has not sold or shared (for cross-context behavioral advertising) consumers’ personal information in the preceding 12 months. We do not knowingly sell or share the personal information of consumers under 16 years of age.

Your California Rights

  • Right to Know & Access: Request disclosure of categories and specific pieces of personal information collected.

  • Right to Delete: Request deletion of personal data collected from You, subject to statutory exemptions.

  • Right to Correct: Request correction of inaccurate personal data maintained about You.

Children’s Privacy

Our Service does not address anyone under the age of 13. We do not knowingly collect personally identifiable information from children under 13. If You discover that a child has provided Us with Personal Data, please contact Us immediately.
